Terms & Conditions
01 Quote Acceptance
1.1 This quote is valid for 30 days from the date of issue. After this period the quote may be subject to revision.
1.2 Acceptance of this quote (by signed copy, email, or verbal or written confirmation) constitutes the Customer’s agreement to these Terms
and Conditions in full.
1.3 Works will not commence until written or verbal acceptance has been received.
02 Basis of Quote
2.1 This quote is based solely on the information, plans, and/or site access provided to us at the time of quotation. Any inaccuracies or
omissions in the information supplied may affect the final price.
2.2 The quote covers only the scope of works expressly described. Any works outside this scope will be treated as a variation (see Clause 4).
03 Existing Installations
3.1 This quote assumes that all existing cabling, switchboards, appliances, and associated infrastructure are serviceable, safe to reuse, and
compliant with applicable Australian Standards and wiring rules in force at the time of installation.
3.2 We accept no responsibility for faults, defects, or failures in existing installations that are beyond the scope of the quoted works.
04 Variations
4.1 Any additional works identified during the course of the project — including but not limited to rectification of non-compliant items, unforeseen site conditions, changes in scope, or works arising from testing — will be treated as variations and charged as additional labour and materials.
4.2 All variations require written approval from the Customer (including via email or SMS) before works proceed. We will endeavour to provide a cost estimate for any variation prior to commencing that work.
05 Non-Compliant Electrical Items
5.1 Any circuits or installations found to be non-compliant with applicable standards during the course of works will be left isolated for safety.
5.2 Rectification of non-compliant items will not proceed without written Customer approval and will be charged as a variation.
5.3 We accept no liability for loss, damage, or inconvenience arising from the isolation of non-compliant circuits or installations.
06 Hazardous Materials
6.1 If hazardous materials (including asbestos, lead-based products, or other regulated substances) are discovered during works, we reserve the right to suspend works immediately.
6.2 Removal or management of hazardous materials is outside the scope of this quote and will require engagement of a suitably licensed contractor. Any delay or cost arising from this is the Customer’s responsibility.
07 Certificate of Electrical Safety /
Compliance
7.1 Where required by law, a Certificate of Electrical Safety will be issued upon completion of works and full payment of all outstanding invoices.
7.2 The certificate fee is included in the price of this quote.
08 Payment Terms
8.1 Unless otherwise stated in writing:
- A deposit of 50% of the total quoted price may be requested prior to commencement of works.
- The full balance is due within 14 days of the date of the final invoice.
8.2 Payment may be made by EFT or online via card. Please note that card payments may attract a processing fee.
8.3 Invoices not paid by the due date may attract interest at a rate of 18% per annum, charged monthly on the outstanding balance. We reserve the right to engage a debt recovery service. All recovery costs will be borne by the Customer.
8.4 Title in any goods supplied remains with us until payment is received in full.
09 Cancellation
9.1 If the Customer cancels or postpones works after acceptance of this quote, we reserve the right to charge for:
- Any materials ordered or fabricated specifically for the job.
- Any reasonable preparatory costs incurred prior to cancellation.
- Any lost time where insufficient notice was provided (minimum 24 hours’ notice required).
10 Customer Responsibilities
10.1 The Customer is responsible for:
- Providing accurate and complete information relevant to the scope of works.
- Ensuring safe, clear, and timely access to all areas required for the works.
- Ensuring the site complies with applicable Work Health & Safety requirements prior to our attendance.
- Notifying us of any known hazards, special conditions, or restrictions on site.
10.2 Where access delays or inadequate site conditions cause our crew to be stood down or required to return, additional call-out and labour charges will apply.
11 Workmanship Warranty
11.1 We warrant that all labour and workmanship performed under this quote will be carried out in a professional and tradesperson-like manner, and will be free from defects for a period of 6 months from the date of completion.
11.2 This warranty does not cover damage caused by misuse, accident, unauthorised modifications, or works carried out by others after our
completion.
11.3 Warranty claims must be notified to us in writing within the warranty period.
12 Product & Materials Warranty
12.1 All products and materials supplied are covered solely by the relevant manufacturer’s warranty. We will assist the Customer in making warranty claims where reasonable, but accept no additional liability beyond the manufacturer’s terms.
12.2 Warranty for materials does not cover normal wear and tear, improper use, or damage caused by third parties.
13 Limitation of Liability
13.1 To the maximum extent permitted by law, our total liability to the Customer for any claim arising out of or in connection with this quote or the works performed shall not exceed the total value of the contract.
13.2 We are not liable for any indirect, consequential, or economic loss suffered by the Customer, including but not limited to loss of income, loss of use, or damage to property not directly caused by our works.
13.3 Nothing in these terms limits any rights the Customer may have under applicable consumer protection legislation.
14 Goods & Services Tax (GST)
14.1 All prices quoted are exclusive of GST. Where GST is applicable, it will be itemised separately on the invoice.
15 Insurance
15.1 Southwest Power Solutions holds current Public Liability Insurance to the value of $20,000,000. A certificate of currency is available upon request.
16 Disputes
16.1 In the event of a dispute arising out of these terms or the works performed, both parties agree to first attempt to resolve the matter in good faith through direct communication.
16.2 If the dispute cannot be resolved within 14 days, either party may refer the matter to the relevant state building or electrical disputes
tribunal.
17 Governing Law
17.1 These Terms and Conditions are governed by the laws of Western Australia, Australia. Both parties submit to the exclusive jurisdiction of
the courts of that state.
